With EAD, or AP for travel, it is important to apply renewal of documents exactly 120 days prior to current document�s expiration date. If you file the renewal application earlier than 120 days prior to expiration, the USCIS may deny the application. In your case, if AP expires July, then return before the date to avoid issues. Plus, if EAD is current, then there should be no problem with entering U.S again. I am out of work and not risking it with out of country travel. Check with lawyer. That is important. Two years back, I returned with AP and faced questions at the airport. Check with lawyer before leaving. Why we do these hoop is known only to the almighty. Better to love someone here and settle with life. I am exhausted with all such documents. I have delayed marriage for GC.
What questions did you face at the airport? Was your AP valid when you returned or had expired. Was your EAD valid when you returned? I am thinking of traveling with my family in next few months and my docs are all valid till end of this year. Would that pose any problems?

Hi,
I got a dream job offer and I have not yet applied for OPT. I have not graduated from school and that's why I applied for CPT.
I just want to know can I work on CPT till my OPT arrives? Also would it be of concern to my employer that I am working on CPT as long as I am eligible to work legally full time? Is that something I should intimate my employer about before joining?
I would appreciate if someone can reply really soon.

I am working in USA. I am planning to travel to India next month and require to apply for USA Visa interview.
I have 2 years and 3 months old younger Son who is born in USA and is a American Citizen holding American Passport.
Could you please shar exp. if he will be allowed to be with us during our Visa Interview in New Delhi Embassy. if Yes. pls let me know if there is any requirement for his entry inside the New Delhi Embassy.
Appreciate your reply in this regard.

In fact you will get preferential treatment in the sense that you get a higher priority token fort he actual appointment and the VO maybe more sympathetic to your case. Iam quoting this from my own experience in late 2009 having my daughter who was 1 year and 3 months actually helped our cause we were out of the embassy in 30 minutes while there were people who waited for hours.

I think you should send a copy of the 485 Receipt notice.. This is a classic, Right hand not knowing what the left hand does situation with USCIS..
I received an RFE for my EAD renewal.
It says "Please submit proof that you have filed an I-485 Application"
I have a copy of my receipt of I-485. Would that be enough to send? Why would they ask for proof of I-485? This is my second EAD renewal.

See it does not matter who files, out of state or local. Main thing is if an RFE comes, will your company be willing to give him all details.............. you have to understand, with new attorney it is just you who is filing at the moment, so for just one case will the company give all his financial details (if asked for).

Myemployer sent a wage request to OES . They replied by saying that the prevwailing wage is not available for your zone so they basically gave me a level 1 wage when it should be the leavel 3 wage for eb2...The person said that should not be a problem

Hi,
My wife was pregnant when we did the July 2007 485 filing and now is being asked for the TB Test. It says X ray is mandatory on the letter from USCIS. The Immi DOctor said its really not and really depends on the skin test - so he will write and take care of that in the letter.
Next thing is that I am not with the same employer who I was with when I filed 485 in July 2007. Thus dont have an attorney any more. Do I need to send the response with a G28 form with no Attorney representation from now on OR do I just reply with no G28 form to indicate I no longer have Legal representation?
Whats the right way of handling this?

I am currently on H4 visa and I am planning to pursue an MBA program. If i choose to study in H4, i know i qualify for the California resident fee discount. If i change my visa to F1 for studies, would i not be eligible for the california resident discount? or would i lose the residency status?

I tried a few times for scheduling infopass trying to get Boston which is closer to where I live. But I am getting Lawrence....I guess Boston office is flooded with appointments...Didn't know that Lawrence has a office too.

I just checked the copy sent to me from my law office. It says I-485 pending for the current status. I got the EAD renewed without any problem.
I saw somewhere that you can alos write AOS pending.

Let us see whether any regular EB3 guys are getting approved as per latest visa bulletins.
There is no salt rubbing to anyone.. we all r in the same sinking boat.. To know, if some one got approved in EB 3 might give us some hope.. let's keep bumping it up even if there are none or few approvals..
If some one feels salt being rubbed on his...a...go keep washing and putting ice on it till you you feel comfortable..
