    Bit slow here lately...

    FWIW, I think it has potential, maybe make it a bit darker and moodier, it looks a bit blown out in places. If I may be brutally honest I think the subject matter is much more interesting than the picture itself, but with some more work...

    I am living in US and am currently on AOS (Adjustment of Status), my mom is staying with me on tourist visa but her visa expires in middle of June this year. Last year my father expired and my mother is incapable of taking care of herself alone (she is suffering from pysio frania which basically means she fears strangers and repeats stuff) so i would like to apply for Visa extension for her. Can anyone suggest what points i should take care of while applying for Visa extension for her? or is there any visa under which i can have stay with me in US as dependent??

    Last Status counts situation DOES NOT apply here.
    That rule applies to situations where you've gone from h1b to h4 or ead etc..
    In your case, you can have as many approved h1b petitions as possible since it's really petition approved for that employer and your are merely beneficiary.
    BUT you can ONLY work for 1 employer at a time..
    Going by your situation.. if you have approved h1 from company B and are working with company B. THEN you are okay.. to hell with what company A may choose to do..

    I received an RFE that put my I-485 on hold,

    "In order to process your application further you will need to submit the following:

    1. Evidence of your lawful admission or parole into the United States. Such evidence includes, but is not limited to, Form I-94 Arrival/Departure Record, or a copy of the nonimmigrant visa page of your passport showing admission to the United States.

    OR

    2. If you last entered the United States without inspection, you must submit evidence of your eligibility for adjustment of status under section 245(i) of the Immigration and Nationality Act (INA). To be eligible for adjustment under 245(i) of INA, you must be the beneficiary of an immigrant visa petition or application for labor certification filed on or before April 30th, 2001. Unless not required in the instructions for Supplement A, you must pay the required section 245(i) surcharge fee.

    Please submit evidence of eligibility under section 245(i) of INA and a completed and signed Supplement A to Form I-485. Evidence of eligibility includes Form-I797, Notice of Action for Form I-130, I-140, or I-360. This form must have been filed on or before April 30th, 2001. You must have been the beneficiary, spouse of the beneficiary, or eligible childe of the beneficiary. The relationship had to exist on or before April 30th, 2001 or when the petition was filed."

    I came across from Canada when I was five years old as a visitor, did not have a passport as one was not required to enter the U.S. from Canada. When we entered we intended to visit my mothers husband and then all of us go back to Canada. However we decided to stay here. My question is, what can I provide as evidence of entering the United States since I did not have a passport and entered as a visitor so I do not have an I-94, and I believe I dont apply to the 245(i).

    I called Immigration and they mentioned form I-102 to replace I-94, theres an option E on the form that says "I was not issued Form I-94 when I entered as a nonimmigrant, and I am filing this application together with an application for an extension of stay/change of
    status." Would this be the right route? Would I receive an I-94? Is there something else I need to send?

    I have an idea. We can make following proposal to lawmakers....

    In next 2 years they can sunset EB3 catagory. In exchange for that they will give visa numbers enough for everyone whose EB3 485 is pending or in pipeline(labor, 140)

    What you guys think of this idea?

    Anyways there are lot of people who just want to keep EB1 and EB2 catagories. We may get support from them with this proposal......

    @K-man: If you look at the first of the above links you�ll why I chose the gradients - although I see now that there might be a liiiiittle too much red in the composition. Point taken though - thnx ;)

    @Fasterthanlight: The font is not Times New Roman. It�s Charlemagne Std but I think I know where you are getting at - it looks pretty much too standard. Another point taken into consideration - thnx ;)

    Canada has been using this for skilled worker program, where individuals can apply for Canadian permanent residency independently if they fullfill the passmark. Other countries like Australia, UK and New Zealand also follow suit with different types of difficulties.

    How about US? Would US adopt this?

    Hello all,

    I am currently on H1B visa working for an IT company. I have got an admit for this Fall to do my MS and I was planning to study using my EAD. Now there seems to be some risk in using my EAD and so I want to apply for F1. I have applied for I-485 (Adjustment of status) along with my husband's green card application.

    My question is:

    1: Is it a problem to apply for F1 if my I-485 is pending approval ? The reason I ask is, F1 is a Non Immigrant visa and I-485 is for a green card (which is Immigrant visa).

    2: Would my F1 application cause my 485 to be denied or vice versa ?

    Your F-1 will probably be denied since you have expressed intent to immigrate by filing I-485. What's the problem with using EAD (assuming that you are the dependent)?

    I am on H1B visa and my wife has filed N400. We have been married for 1 year and 2 months. she just gave her finger printing on June 10th. we have not yet filed I130 petition as of yet as we were thinking to do that after she gets her citizenship. But today I got laid off from work and the immigration officer mentioned that my wife should file I130 ASAP to avoid deportation. In form I30 On line Item 15 it says to enter the name and address of present employer. I got laid of from work on June 19 today and my wife is filing this I130 petition on Monday June 23. My termination letter indicates june 19th date. I will receive my last pay stub on July 3rd.
    Should I put the name of the current employer on line 15 or should I say "unemployed" and explain in a seperate piece of paper about recent layoff? I will be out of status and will be inviting immigration if I mentioned that. Please help.

    i am trying to renew my passport, do we need to fill the form online and than submit it online or we have to print, instructions are confusing..pls help out
    I'm in the same boat too and I have filled it online and printed it and it will print with scan code and some more pages which u need to fill later.

    Anybody who had an I94 issued only till the validity of the visa and not until the I-797? At the POE the guy simply wouldn't understand when I tried to explain to him that I have an extension (797) valid from 4/10 t0 4/11. He gave me an I94 only until 4/10. I read that people go for deffered inspection and get it corrected. Anybody who did that in a similar situation active in IV now? Any suggestions on how to proceed? do you go to the nearest international airport or an off-airport location?

    Its common for IOs at POE to do this. Their side of the explanation is that they cannot give you an I-94 based on a I-797 which will be valid in the future. They have to go with a currently valid document. Like others suggested, you will have to either re-enter US immediately after the current I-94 expires or go to the nearest intl airport and get this done by defferred inspection.

    Can you please tell me what restrictions we have at london to travel. I heard some European countries have restrictions to travel.

    Call airlines and British embassy and they should tell you the updated rule.

    My mother-in-law also has plans to apply visitor visa. She is also a widower.

    Is it risk if both my mother-in-law and grand mother (widower) go togethor for visa interview?
